Terms and Conditions

Shipping, Returns, Refund & Chargeback Policy

The Distillery Network Inc., doing business as American Copper Works and Prime Stills ("we," "us," "our"). By placing an order on our website, you agree to these Terms & Conditions, and you acknowledge that your order constitutes full acceptance of this policy.

Handcrafted, Made-to-Order Products

All of our products are handcrafted, made-to-order copper works. By placing an order, you acknowledge that you are commissioning a custom, hand-built item with inherently variable production times, and you agree to the terms below in full.

Production & Shipping Timeframes

Any production or shipping timeframe we state is a good-faith estimate only — not a guarantee, a deadline, or a binding term. Average production and shipping time is approximately 1 to 2 weeks from the date of purchase, but actual timeframes may be significantly longer due to order volume, customization requests, material sourcing, supply-chain conditions, or other factors within or beyond our control.

You expressly acknowledge and agree that:

  • All orders will be fulfilled. A longer-than-estimated lead time does not mean an order has been abandoned, canceled, lost, or is in default.
  • Time is not of the essence. No delay in production, shipment, or delivery — of any length — shall constitute a breach, a failure to perform, or "non-delivery," nor shall it be grounds for cancellation, refund, chargeback, or any claim for damages of any kind.
  • You authorize an open-ended production period reasonably necessary to complete your handmade item, and you agree to await fulfillment.
  • You agree not to initiate any chargeback, bank dispute, or claim of "item not received" while your order is still in production or transit. Your remedy for a delayed order is to contact us and await fulfillment.
  • We offer no discount, credit, or compensation for orders that take longer than estimated.

Estimated dates are provided for convenience only and form no part of any contractual obligation. If you need expedited production or special delivery arrangements, contact Owner@PrimeStills.com before or after ordering.

Order Communication

Once your order is completed and shipped, you will receive an email with tracking information. If you have questions about the status of an order, you agree to contact us directly — by phone, text, or email — and to allow us a reasonable opportunity to respond before pursuing any other remedy.

Title, Risk of Loss & Shipping Damage

Title and risk of loss pass to you at the time your order is delivered to the carrier. We are not responsible for, and expressly disclaim all liability for, any loss, theft, damage, delay, misdelivery, or non-delivery caused by carriers, weather, customs, incorrect or incomplete shipping information you provide, or any other circumstances beyond our reasonable control. Copper is a soft metal; all units are packaged securely, but minor surface marks, dents, or dings may occur in transit. These are cosmetic, do not affect functionality, and are not grounds for a refund or return.

Nature of Handmade Copper

Each unit is individually handcrafted and may vary slightly in finish, patina, weight, dimensions, or appearance from product photos or descriptions. These variations are normal characteristics of handmade copper work and are not defects. We do not accept returns or refunds based on minor cosmetic or dimensional variations. Copper naturally oxidizes and requires ongoing care and maintenance; we are not responsible for polishing, oxidation, patina development, water spotting, or similar changes that occur after delivery. Care and support information is available on our website or by contacting us directly.

Assumption of Risk & Limitation of Liability

By purchasing and using our product, you expressly agree not to hold The Distillery Network Inc., its owners, officers, or affiliates liable for any damage, injury, harm, loss, or expense of any kind arising from the possession, use, misuse, storage, or installation of our product.

  • Assumption of all risk: You assume all risk associated with the product and its use. It is your sole responsibility to operate the product safely and to research and comply with all applicable federal, state, and local laws, which vary by jurisdiction.
  • No liability for outcomes: We are not responsible for any outcome resulting from the use of our product, including but not limited to property damage, personal injury, or legal consequences.
  • Waiver of claims: To the fullest extent permitted by law, you waive all product liability claims, and you agree that our maximum liability, if any, shall not exceed the amount you paid for the product.
  • Warranties: Improper use, modification, or installation of the product voids any and all implied warranties to the fullest extent permitted by law.

Returns & Refunds

If you are not completely satisfied, you may return your product within 30 days of delivery for a refund, repair, or exchange — your choice — subject to the conditions below.

  • Return shipping: You are responsible for return shipping costs on all non-defective returns.
  • Defective items: If an item is defective or damaged on arrival, we cover return shipping and will repair or replace it at no cost to you.
  • Original shipping charges are non-refundable unless the item was defective or damaged upon delivery.
  • Condition: Returns of unused items in original, like-new condition and packaging may be eligible for a full refund. A 15% restocking fee applies to non-defective returns that have been opened, used, or are not in like-new condition.
  • Excluded from return: Minor cosmetic or dimensional variations inherent to handmade copper, oxidation or patina changes after delivery, and minor transit marks are not grounds for return.

Refund timing: After we receive and inspect your return, we will notify you by email of approval or rejection. Approved refunds are issued to the original payment method; please allow up to 21 calendar days from the date of approval for funds to post, depending on your bank or payment provider.

Cancellations

A 15% restocking fee applies to any order canceled by the customer, whether or not the unit has shipped. Because our products are made to order, custom orders cannot be canceled once production has begun. We reserve the right to delay shipment or to cancel and refund an order if materials become unavailable.

After 30 Days — Lifetime Warranty

Beyond the 30-day window, we continue to offer repair or exchange for eligible items covered under our Lifetime Warranty. You are responsible for shipping costs related to warranty service after 30 days. Improper use, modification, or installation of the product voids any and all implied warranties to the fullest extent permitted by law.

How to Return or Exchange

  1. Email Owner@PrimeStills.com with your order number and reason for return.
  2. Ship your item, using a trackable method (keep your tracking number), to: American Copper Works
    50 Bridge Street
    Nashua, New Hampshire 03060 USA

We are not responsible for returned items lost in transit without tracking.

Chargebacks & Disputes

By completing a purchase, you agree to these terms and to resolve any concern with us directly before initiating a chargeback.

  • Contact first: You must contact us and allow a reasonable opportunity to resolve any issue before disputing a charge.
  • We contest improper chargebacks: We actively dispute all improper chargebacks by submitting proof of order authorization, shipment, and delivery. Your online order, shipping confirmation, and communications with us serve as evidence that the transaction was authorized and the product accepted.
  • Customer responsibility: If a chargeback is found invalid or is reversed, you agree to accept full responsibility for all fees, administrative expenses, and legal or banking costs we incur in defending the dispute.
  • Breach: Initiating a chargeback without legitimate cause — including any dispute based on a delay while your order is still in production or transit — constitutes a breach of these Terms & Conditions. To the fullest extent permitted by law, you forfeit any right to a refund and may be held responsible for the full order amount plus processing and collection fees, and we reserve the right to pursue recovery through all applicable channels.

Dispute Resolution

By placing an order, you agree that any dispute arising from a purchase shall be resolved through binding individual arbitration, and you waive any right to participate in a class action, to the fullest extent permitted by law.

Acceptance

By completing a purchase, you accept this policy in full and agree to be bound by all of its terms.

The Distillery Network Inc. — We stand by our products, our customers, and our commitment to fairness in every transaction.
